Terms of Use

We have drafted these Terms of Service (we refer to them as the Terms) so that you will understand the rules that govern our relationship with you as a user of our Services. These Terms constitute a legally binding contract between you ("User", "you") and us ("us"). So please read carefully.

 

By using Scan Wallet and engaging in services subject to these Terms (we collectively refer to them as the Services), you agree to these Terms. If so, we grant you a non-transferable, non-exclusive, revocable, and non-sublicensable license to use the Services in accordance with these Terms and our policies. Of course, if you do not agree to these Terms, please do not use the Services.

 

ARBITRATION NOTICE: We agree that disputes between us will be resolved by binding arbitration, except for certain types of disputes set forth in the Arbitration and Class Action Waiverprovision below, and we jointly waive any right to participate in a class action lawsuit Rights - Litigation or Class Arbitration. You have the right to opt out of arbitration as described below.

Who can use these services

 

Our Services are not directed to children under the age of 18, and you must confirm that you are over 18 years old to create an account and use the Services. If we have actual knowledge that you are under 18 years of age (or the minimum age in your state, province or country to use the Services without parental consent, if greater), we will stop providing the Services to you and delete your account and data. We may offer additional services with additional terms that may require you to be older to use them. Therefore, please read all such terms carefully. By using the Service, you represent, warrant and agree:

 

i. You can enter into a binding contract with us;

ii. You are not a person prohibited from using the Services in any other applicable jurisdiction; and

iii. You will comply with these Terms and all applicable local, state, national and international laws, rules and regulations.

 

Rights you grant to us


Many of our services allow you to create, upload, publish, send, receive and store content. When you do so, you retain all ownership rights to that content. For all Content you submit to the Service, you grant us and our affiliates a world-wide, royalty-free, sublicensable and transferable license to host, store, cache, use, display, reproduce, modify, adapt, edit , posting, analyzing, transmitting and distributing this content means you will not be entitled to any compensation. This license is for the purpose of operating, developing, providing, promoting and improving the Services and researching and developing new Services. This license includes the right for us to make your content available to service providers and to pass those rights to the service providers. Our contractual relationship in relation to the provision of services is solely for the purpose of providing such services.

Although we are not required to do so, we may access, review, screen and remove your Content at any time and for any reason, including to provide and develop the Services or if we believe that your Content violates these Terms or any applicable law. However, you remain responsible for the content you create, upload, publish, send or store through the Services.

You are solely responsible for all Content you submit to the Service, whether that Content is posted publicly or sent privately. (When we say "your Submissions" and similar terms, we mean any content that you seek to post, transmit, or share, including but not limited to text, images, sound, video, graphics, information, or other data.)

 

You agree not to submit any of the following:


1. Infringes any intellectual property or other proprietary rights of any party;

2. You do not have the right to submit;

3. Contains software viruses or any computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware or telecommunications equipment;

4. Create a privacy or security risk to any person;

5. Constitute unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, "junk mail," "spam," "chain letters," "pyramid schemes," "contests," "sweepstakes," or any other form of solicitation;

6. Threats, abuse, harassment, infringement, bullying or excessive violence;

7. Is defamatory, defamatory or provably false, with the purpose of harming others;

8. Hate speech that constitutes disparagement or promotion of discrimination or violence based on race, ethnicity, gender, religion, age or other social, physical or psychological characteristics;

9. Obscene or pornographic content;

10. constitutes sexual harassment;

11. Constituting sexual exploitation or abuse of minors, including sharing childrens Sexual exploitation or abuse imagery or content, grooming or sextortion;

12. Glorifying self-harm, including self-harm, suicide or eating disorders;

13. Promote terrorism or violent extremism;

14. Promote or facilitate criminal activities;

15. Content that, in the sole judgment of Scan Wallet, is objectionable or restricts or inhibits any other person from using or enjoying the Services, or may subject Scan Wallet or its users to any harm or liability.

 

You also agree not to do any of the following while using the Services:


1. Violate any requirements, procedures, policies or regulations of networks connected to the Service;

2. Violate any applicable laws or regulations;

3. Impersonate any person or entity, or misrepresent your relationship with a person or entity;

4. Request personal information from anyone under the age of 18;

5. Obtain or collect the email addresses or other contact information of other users from the Service by electronic or other means for the purpose of sending unsolicited emails or other unsolicited communications;

6. Obtain or attempt to obtain any information through any means not intentionally provided or provided through the Service;

7. Lease, loan, sell or sublicense any part of the Services;

8. Attempt to evade any technical measures designed to protect the Services or any technology related to the Services; or

9. Reverse engineer, disassemble, decompile, decode, adapt or otherwise attempt to derive or obtain access to all or part of the source code of any Service (unless portions of the code in the Service are released as open source and the open source license is governed by this Reverse engineering, copying, or other modification of the class code is expressly permitted).

Additionally, while we reserve the right to review, moderate, or remove all Content appearing on the Service, we do not review all Content. Therefore, we cannot and do not guarantee that other users or the content they provide through the Services will comply with our Terms or our other terms, policies or guidelines.

 

Your Rights


If you would like more information about your legal rights under applicable law or would like to exercise any of them, please feel free to contact us using the information in the "How to Contact Us" section below. Your local laws may allow you to ask us to:

Provide access to and/or a copy of certain information we hold about you

Prevent the processing of your information for direct marketing purposes (including any profiling-based direct marketing processing)

Delete certain information we hold about you

Limit how we process and disclose certain of your information

Transfer of your information to third party service providers

Withdraw your consent to the processing of your information

We will consider all requests and respond within the deadlines prescribed by applicable law. However, please note that certain information may be exempt from such requirements in certain circumstances, which may include whether we need to continue to process your information for our legitimate interests or to comply with a legal obligation. We may ask you to provide us with information necessary to confirm your identity before responding to your request.

 

Modification of This Policy


The effective date of this Policy is set forth at the top of this webpage. We reserve the right to amend this Policy at any time with or without notice and will place any updates on this webpage. The amended Policy supersedes all previous versions. Your continued use of Services on the Platforms will be taken as acceptance of the updated Privacy Policy.
